1. Definitions
"Service" means the Leadtrak.ai application, including the funnel builder, lead tracking and attribution features. "Customer" means the person or organisation that creates an account. "Lead Data" means personal data submitted by respondents through funnels the Customer publishes.
2. Acceptance
By creating an account or using the Service you agree to these terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it.
3. The trial and plans
Every paid plan begins with 30 days of full Growth-tier access at no charge and without a payment card. At the end of the 30 days the account converts to the permanent free plan; your funnels, leads and data are retained and the account is not deleted. Paid plans are billed annually at the rates shown on the pricing page. All plans include unlimited users.
4. Billing and overage
You are billed for leads captured above your plan allowance at the per-lead rate for that plan. We warn you in-product at 80% of allowance. We do not block a lead from being captured; overage is billed afterwards. Prices are exclusive of VAT unless stated. You may cancel at any time; paid periods are not pro-rated unless required by law.
5. Data processing
Where the Customer uses the Service to collect Lead Data, the Customer is the controller and Leadtrak.ai is the processor. These terms incorporate data processing terms consistent with UK GDPR, including: processing only on documented instructions, confidentiality of personnel, security measures, sub-processor disclosure, assistance with data subject requests, and deletion or return of data on termination. A standalone Data Processing Addendum is available on request.
6. Customer responsibilities and acceptable use
You are responsible for the lawfulness of the Lead Data you collect and for providing an appropriate privacy notice to respondents. You agree not to: use the Service for unlawful purposes; collect special-category data (as defined in UK GDPR Art. 9) without a valid lawful basis; attempt to breach security; reverse-engineer the Service; or use it to send spam. We may suspend an account that violates this section after reasonable notice, where urgent risk requires immediate action we may act first and notify after.
7. Intellectual property
We own the Service and its software. You own your Lead Data and the content you create in your funnels. You grant us a limited licence to process your content solely to provide the Service.
8. Availability and changes
We aim for high availability and provide status at /status/. We may update the Service and these terms; material changes are notified by email or in-product. Continued use after changes take effect constitutes acceptance.
9. Limitation of liability
The Service is provided "as is" to the maximum extent permitted by law. We are not liable for indirect or consequential loss, or for loss of profit, data or business, arising from use of the Service. Our aggregate liability under these terms is limited to the amounts you paid in the 12 months before the claim. Nothing excludes liability that cannot be excluded under English law, including for death or personal injury caused by negligence.
10. Termination
You may close your account at any time. We may terminate for material breach after notice and a reasonable cure period. On termination we make your data available for export for a defined period, then delete or anonymise it subject to legal retention obligations.
11. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
